Supreme Court Receives Malur Recount Outcome Directly, Bypassing Election Commission's Involvement in the Matter.

The Supreme Court is set to receive the recount results from the Malur Assembly constituency, not directly from the Election Commission of India (ECI). This development follows a series of legal challenges and recounts ordered in the aftermath of the 2023 Karnataka Assembly elections.

In the 2023 election, K.Y. Nanjegowda of the Congress party narrowly defeated K.S. Manjunath Gowda of the Bharatiya Janata Party (BJP) by a mere 248 votes. Manjunath Gowda subsequently filed a petition with the Karnataka High Court, alleging irregularities in the counting process, including unauthorized handling of electronic voting machines (EVMs) and questionable actions by election officials. He claimed discrepancies in tabulation and was allegedly denied a re-totaling of the count.

The Karnataka High Court, in September 2025, ruled in favor of Manjunath Gowda and declared Nanjegowda's election void, ordering a recount of the votes within four weeks. The High Court also noted the absence of crucial video recordings of the counting process, except for the VVPAT process, raising concerns about transparency.

Nanjegowda then appealed to the Supreme Court, challenging the High Court's decision. On October 14, 2025, the Supreme Court stayed the High Court's order, allowing Nanjegowda to continue serving as MLA. However, the Supreme Court upheld the directive for a recount, instructing the ECI to conduct the recount and submit the results to the court in a sealed cover. The Supreme Court clarified that the recount results should not be disclosed without its permission.

The recounting of votes for the Malur Assembly constituency was conducted on November 11, 2025. The Kolar District Election Officer and Deputy Commissioner were instructed to oversee the process, adhering to the Supreme Court's October 14 order and guidelines from the ECI. The counting took place in the premises of the Deputy Commissioner's Office in Kolar. The process was conducted in front of the candidates, and the result was sealed for submission to the Supreme Court.

BJP leaders had earlier submitted a memorandum to the Kolar District Deputy Commissioner, expressing concerns about potential voter fraud and urging for a fair and transparent recounting process under camera surveillance.
