Evicted: Man and Wife Face 60-Day Deadline to Vacate Mother's Residence Following Dispute.

A man and his wife have been ordered to vacate his 62-year-old mother's home in Parel's Parsi Baug within 60 days, following accusations of physical and mental abuse. The maintenance and welfare of parents and senior citizens tribunal issued the order after reviewing statements from both parties. The elderly mother, a widow, is a licensee of the 600 sqft residence, which belongs to the Bombay Parsi Punchayet (BPP) Trust.

The dispute began when the mother, represented by advocate Adnan Mookhtiar, sought the eviction of her son and daughter-in-law on April 27, 2023. She alleged consistent mental and physical harm, stating she has no independent source of income. According to the plea, the daughter-in-law verbally abused and physically assaulted her, leading to a non-cognisable police complaint. Further accusations included the couple filming her without consent and restricting her movement within her own home, which she claimed was deteriorating her health. Citing fear for her safety, the mother requested their eviction and financial maintenance.

The son, however, presented counter-allegations, claiming that his mother and sister subjected his non-Parsi wife to severe harassment. He stated that his wife and five-year-old daughter were verbally and physically abused, ostracized, locked out of the house, and deprived of food after the gas supply was cut off. He also mentioned paying his mother Rs 2,000 a month as per an interim order but admitted to missing recent payments due to job loss.

The BPP Trust had previously directed the son to vacate the premises in a letter dated January 14, but he did not comply. The tribunal noted the accusations from both sides and deemed it inappropriate for them to continue residing in the same house. While the tribunal addressed the eviction matter, the parties retain the right to pursue further legal action regarding the abuse allegations.
