Rajasthan is set to introduce a bill aimed at curbing what it perceives as "demographic imbalance" in certain areas of the state. The Rajasthan Prohibition of Transfer of Immovable Property and Provisions for Protection of Tenants from Eviction from the Premises in Disturbed Areas Bill, 2026, received cabinet approval on Wednesday and is slated to be tabled during the upcoming budget session of the Rajasthan Assembly, commencing on January 28.
The bill empowers the state government to declare areas affected by violence, mob unrest, or "improper clustering" as "disturbed areas". Once an area is designated as such, property transfers would be rendered null and void unless approved by a competent authority, such as the District Magistrate. According to State Parliamentary Affairs Minister Jogaram Patel, this measure is intended to address situations where "demographic imbalance" affects public order and communal harmony, often leading to permanent residents being forced to sell their properties at low prices, especially during riots or mob violence. The government aims to protect property rights and maintain social harmony amidst growing unrest in the state.
The key features of the bill include:
- Restriction on Property Transfers: In "disturbed areas," the transfer of immovable property without prior permission from a competent authority will be invalid.
- Protection of Tenants: The bill aims to protect tenants from forced evictions.
- Maintenance of Demographic Balance: The government aims to maintain demographic balance in the identified areas, even in the absence of riots.
- Punitive Measures: Violations of the bill's provisions will be treated as cognizable and non-bailable offenses, carrying a punishment ranging from three to five years of imprisonment along with a fine.
The government has stated that the new law will ensure that property owners are not compelled to resort to distress sales at throwaway prices, and tenants will not be forced to vacate their premises. The legislation is modeled on a similar law in Gujarat.
In addition to the Disturbed Areas Bill, the Rajasthan cabinet has also approved new policies for aerospace, defense manufacturing, and semiconductors, signaling a broader push for industrial development in the state. These initiatives are expected to boost manufacturing and create high-tech jobs. The Aerospace and Defence Manufacturing Policy is expected to pave the way for large, mega, and ultra-mega manufacturing projects, potentially including aircraft assembly and manufacturing. The Semiconductor Policy aims to facilitate the manufacturing of semiconductor chips within the state.
