High Court rules against sealing all Sunjay assets case records, ensuring transparency and public access.

The Delhi High Court is currently scrutinizing a request by Priya Kapur, the wife of the late businessman Sunjay Kapur, to submit details of his assets in a sealed cover in an ongoing dispute over his will. The dispute arises from a partition suit filed by Sunjay Kapur's children from his previous marriage to actress Karisma Kapoor, Samaira and Kiaan, who are seeking a share in their father's estate and allege that the will is not valid.

Priya Kapur's application seeks permission to file a list of Sunjay Kapur's personal assets and liabilities in a sealed cover, with all parties bound by confidentiality. As an alternative, she proposed the formation of a "Confidentiality Club". She argues that the sensitive financial details involved could be a "question of cyber security" and that there has been media attention with "pleadings leaking". Her lawyer, Senior Advocate Shyel Trehan, emphasized that she wasn't against disclosing the assets, but wanted to prevent leaks to the media and the public, suggesting that only two pages of the asset details be kept confidential. She also stated that lawyers involved in the matter were publicizing the case.

Justice Jyoti Singh, however, raised concerns about the implications of such an order. The court orally flagged that preventing the plaintiffs from questioning or verifying the disclosed assets could be "problematic", impinging on the parties' right to question the assets disclosed. She questioned how the plaintiffs could verify the list if bound by a confidentiality clause and how any party could defend their case under such restrictions. The court also asked what was so exceptional in this partition suit and how it was different from any other case. Justice Singh sought judicial precedents for sealed cover submissions of asset disclosures.

Samaira and Kiaan, Sunjay Kapur's children, opposed Priya's request. Their lawyer, Advocate Saurav Agrawal, argued that the confidentiality sought was to cover up transactions after Sunjay's death, alleging that "bank accounts have been wiped off". They contend that the world should know about the assets to prevent any illicit dealings. They also stated that assets worth around ₹1,900 crore have already been transferred to them.

Senior Advocate Amit Sibal, representing Rani Kapur, Sunjay's mother, also opposed Priya's request and sought a copy of the will to independently verify its authenticity. He argued that a confidentiality clause or sealed cover submission should not prevent forensic testing of the will.

The court directed Priya Kapur to disclose all of Sunjay Kapur's assets in a previous hearing on September 10, 2025. The children, through their mother Karisma Kapoor, claim that the will, dated March 21, 2025, which allegedly leaves Sunjay Kapur's entire personal estate to Priya, is not a legal and valid document and is "forged and fabricated".

Priya Kapur's lawyers have argued that there is enough evidence to show the will in question was created and executed much before Sunjay Kapur's death. Sunjay Kapur passed away on June 12, 2025.

The High Court has adjourned the matter, asking Priya Kapur's counsel to provide a suggestion that is amenable to all parties involved. The court has also asked for precedents regarding sealed submissions in such suits. The case is scheduled for further hearing.
