In a chilling case that underscores the power of a child's testimony, an 11-year-old girl's bravery has led to her mother, grandmother, and three uncles being sentenced to life imprisonment for the murder of her father. The Aligarh local court's decision, delivered on Saturday, marks the end of a harrowing ordeal that began with the disappearance of Shafiq in May 2022.
Shafiq's brother, Farid, filed a police complaint after Shafiq went missing on May 12, 2022. He revealed that Shafiq had married Juli, the accused, in a love marriage about 12 years prior, and they resided near her family's house. The family's search for Shafiq proved futile until his own daughter disclosed the horrifying truth: her mother, grandmother, and uncles had murdered him following a dispute and concealed his body within their home.
The young girl, a Class 3 student, bravely recounted the events to the court. Her testimony detailed a brutal attack in which her mother struck Shafiq with a brick while her uncles and grandmother held him down and strangled him. The perpetrators then poured a liquid on him to ensure he was dead. The girl further testified that the body was kept in the house for two days, during which she was threatened to remain silent.
After noticing a stench, Juli, her mother Munni, and siblings Shahrukh, Nannu, and Shama wrapped the body in a blanket. They then transported it on a battery rickshaw and dumped it near a water tank. Farid noted that his niece appeared scared and nervous when she revealed these details.
Police investigations led to the discovery of an unidentified body, which the family later identified as Shafiq. Authorities registered a case under several sections of the Indian Penal Code, including murder, criminal conspiracy, causing disappearance of evidence, and criminal intimidation. All the accused were arrested and taken into custody.
Additional sessions judge Nawal Kishore handed down life sentences to all five convicts and imposed a fine of Rs 45,000 on each of them. Additional district government counsel Swaran Lata confirmed the sentence.
This case highlights the crucial role children can play in seeking justice, even when facing immense pressure and fear. The 11-year-old girl's courageous testimony pierced through a web of deceit and brought the perpetrators of a heinous crime to justice. It also serves as a reminder of the importance of protecting and supporting child witnesses, ensuring they can safely share their experiences and contribute to a fair legal process.
