Concerns regarding the neutrality and credibility of the Election Commission (EC) have been raised, with calls for parliamentary oversight to ensure its impartiality.
Senior Congress leader Gaurav Gogoi has been a vocal critic, alleging that the neutrality of the Election Commission is questionable. He has questioned the central government's decision to not allow a discussion on the EC in Parliament, especially since the Chief Election Commissioner is appointed by the government. Gogoi argues that there is a "question mark" in the minds of the people regarding the EC's neutrality, necessitating a parliamentary discussion. He suggests the government might be trying to conceal potential manipulation in past elections.
Gogoi has emphasized the importance of transparency regarding voter lists and polling station details. He stated that the opposition seeks an open discussion in Parliament about the voter list revisions, particularly in Bihar, so that citizens are aware of their voting rights. He has dismissed the logic that the Election Commission is unrelated to any department as "absurd" since the Prime Minister and government appoint the Chief Election Commissioner.
Concerns have also been raised about the reliability of electronic voting machines (EVMs). Gogoi has requested the Election Commission to release data on the number of EVMs found faulty during the Lok Sabha polls. He stated that he can confidently say that these machines have shown inaccurate results.
These concerns come amidst discussions regarding simultaneous elections. Former Chief Justice of India, Ranjan Gogoi, cautioned a Joint Committee of Parliament about the constitutional validity of some provisions of the Bills on simultaneous elections. Gogoi raised doubts specifically about Article 82A (5), suggesting it might grant excessive power to the Election Commission and may not pass constitutional muster. This clause allows the EC to opt out of holding certain Assembly elections alongside Lok Sabha elections.
These concerns highlight the need for greater accountability and transparency in the electoral process. Gogoi has urged Prime Minister Narendra Modi to address Parliament on critical issues, including the Election Commission's functioning, defense challenges, and foreign policy tensions.
