Aam Aadmi Party (AAP) is accusing the Bharatiya Janata Party (BJP) of conspiring to destabilize the Delhi government by leveling fabricated charges against its leaders. This accusation comes in response to the newly proposed 130th Constitution Amendment Bill, which aims to remove Prime Ministers, Chief Ministers, and Ministers if they are detained for more than 30 days on serious criminal charges.

Anurag Dhanda, AAP national media in-charge, stated that the charges against senior AAP leaders, including former Delhi Chief Minister Arvind Kejriwal and former minister Satyendar Jain, were "fabricated". Dhanda claimed that the BJP and Amit Shah orchestrated a conspiracy to bring down the AAP government by pressing fake charges. He added that people remember Kejriwal's governance even while he is in jail.

Dhanda compared Kejriwal's governance to that of the current Chief Minister, Rekha Gupta, and said that Gupta is struggling with key civic issues while Kejriwal is remembered for his administrative work. He noted problems such as rising private school fees, sewage on the streets, increased crime, water shortages, and power cuts.

Arvind Kejriwal also criticized Union Home Minister Amit Shah, questioning the ethics of inducting criminals into political parties and rewarding them with high office. He asked how many years of imprisonment should be given to someone who includes criminals in their party and then makes them Prime Minister or Chief Minister.

Kejriwal was arrested in March of last year by the Enforcement Directorate in connection with a money laundering case linked to the excise policy. He was the first sitting chief minister to be arrested.

AAP has often accused the BJP of inducting tainted leaders accused of serious offenses into their party, frequently referring to the BJP as a “washing machine”. The AAP has also alleged that Kejriwal and other leaders have been arrested by central probe agencies in false cases at the BJP-led central government's behest.

The Constitution (130th Amendment) Bill, 2025, introduced during the Monsoon session of Parliament, has faced criticism from parties alleging it will allow the targeting of political opponents. The bill seeks to remove any Prime Minister, Chief Minister, or Minister detained for 30 consecutive days on charges punishable by at least five years of imprisonment. If the arrested leader doesn't resign, the office will automatically become vacant after 31 days; however, the bill allows for re-appointment post-release.

Union Home Minister Amit Shah has defended the bill, stating that it is aimed at upholding constitutional morality and public trust and would apply equally to all leaders, including those from the ruling party. He expressed confidence that the bill would pass, expecting support from those who uphold morality. Shah also addressed concerns about a Prime Minister or Chief Minister running the country from jail. He highlighted that the Prime Minister himself insisted on including the office of the PM under this bill.

Conversely, Rajya Sabha MP Sanjay Singh of the AAP has charged that the bill is designed to jail opposition leaders in false cases and topple elected governments.

BJP leader Suvendu Adhikari supported the bill, stating that the public wants such a law and that the Constitution is "for the people, of the people, and by the people," not for any political party. He added that corrupt leaders are going to jail and those trying to stop the bill are united for their own protection.
