The Delhi High Court is currently hearing a dispute over the inheritance of the late Sunjay Kapur's estate, estimated to be worth ₹30,000 crore. The legal battle involves Sunjay Kapur's children, Samaira and Kiaan, from his marriage to actress Karisma Kapoor, and his widow, Priya Kapur. The children are challenging a will that purportedly leaves Sunjay Kapur's entire personal estate to Priya Kapur, claiming the will is forged and fabricated and deliberately excludes them.
In a recent development, the Delhi High Court has allowed Priya Kapur to file a list of Sunjay Kapur's assets in a sealed cover. The court has also suggested that all parties involved in the property dispute refrain from sharing details with the media.
Justice Jyoti Singh, presiding over the case, has expressed reservations about the confidentiality request, emphasizing the importance of transparency in inheritance disputes, especially when other heirs have a legitimate claim. The court questioned how Karisma Kapoor's children could effectively verify the disclosed assets and defend their case if bound by a confidentiality agreement. Justice Singh also inquired about any legal provisions that would allow asset disclosures to remain confidential. The court noted that NDAs are uncommon in family and inheritance law.
The lawyer representing Samaira and Kiaan argued that the bank accounts purportedly disclosed by Priya Kapur as containing Sunjay's wealth have been emptied. Additionally, Sunjay Kapur's sister, Mandhira Kapur Smith, has stated that the bloodline of Surinder Kapur (Sunjay's father) is "getting nothing of what he created".
Sunjay Kapur passed away on June 12 after suffering a heart attack while playing polo in Surrey, UK. The children claim that their father never mentioned any will during his lifetime and are seeking a partition of his estate, full disclosure of assets, and a permanent injunction against Priya Kapur and other defendants.
Priya Kapur's lawyer, Rajiv Nayyar, has argued that Samaira and Kiaan have already received assets worth approximately ₹1,900 crore through a trust. He also stated that the will does not need to be registered and emphasized that Priya Kapur is Sunjay's last legal wife.
The Delhi High Court has directed the defendants to file replies within two weeks and submit the original will in a sealed envelope along with a complete list of assets. The next hearing is scheduled for October 9, 2025, during which the court will consider granting an interim stay on the assets.
