Delhi HC Grants Ajaz Khan Anticipatory Bail Amid Controversy Over Social Media Post: Relief for Actor.

The Delhi High Court has granted anticipatory bail to actor Ajaz Khan in connection with a case registered against him concerning an allegedly objectionable social media post. Justice Ravinder Dudeja presided over the hearing and granted Khan relief on Thursday, October 9, 2025, under specific conditions.

The case against Khan stems from an FIR filed by the Delhi Police's Cyber Police Station, which was initiated based on a complaint regarding objectionable content posted on social media targeting a YouTuber and their family. The complainant, a woman whose son is a YouTuber, alleged that Khan circulated videos containing offensive material aimed at her and her family, including threats. The specific post in question involves Khan reposting a video on Instagram that was originally created and uploaded to YouTube by the complainant's son, titled "A DAY WITH NAJAYAZ KHAN". The video purportedly contains defamatory remarks, obscene gestures, and false imputations directed at Khan.

Khan's legal representatives, Advocates Khalid Akhtar and Mohd Shadan, argued that Khan neither created, scripted, nor endorsed the video and that it was already publicly available before he reposted it. They further stated that Khan promptly deleted the reposted content.

Earlier, a trial court had rejected Khan's anticipatory bail plea on August 5, citing the necessity of custodial interrogation for gathering digital evidence. The court also noted that Khan had failed to join the investigation despite being served two notices. The Delhi Police argued that Khan's interrogation was crucial for collecting digital evidence related to the case.

In granting anticipatory bail, the High Court considered that the digital devices in question were already in the custody of the Bombay Police. Furthermore, Khan had committed to cooperating with the investigation and providing his voice sample to the Forensic Science Laboratory (FSL). The High Court emphasized that the freedom of speech and expression guaranteed by the Constitution must be exercised within reasonable bounds and that speech that crosses the line into insult, humiliation, or incitement infringes upon the right to dignity.

The conditions for Khan's anticipatory bail include furnishing a personal bond of Rs 30,000 with one surety of the like amount. Justice Dudeja ordered that, in the event of his arrest, Khan shall be released on this bond to the satisfaction of the Arresting Officer, Investigating Officer, or Station House Officer (SHO). The High Court also imposed conditions that Khan surrender his passport to the investigating officer and not leave the country without prior permission from the trial court. He is also required to cooperate in providing his voice samples to the investigating agency when directed.

This ruling follows a previous rejection of Khan's anticipatory bail plea by the Tis Hazari Court in a related case concerning the alleged online publication and dissemination of pornographic content. Moreover, Khan faces separate rape allegations in Mumbai, where an actress filed an FIR accusing him of sexual assault under the pretext of marriage.
