Jubin Nautiyal Seeks Delhi Court's Protection of Personality Rights Amid Rising Concerns Over Misuse.

In a move highlighting the growing concern among celebrities regarding the protection of their image and identity, popular Indian singer Jubin Nautiyal has filed a petition with the Delhi High Court seeking legal safeguards against the unauthorized use of his personality. The petition, which has been submitted to the court, is expected to be heard after the holiday break.

Nautiyal's legal action comes amid increasing instances of voice imitation, fake social media profiles, and unlicensed merchandise that exploit his persona without consent. The plea seeks formal recognition of Nautiyal's identity, including his name, image, and voice, as his exclusive personality right, thus preventing unauthorized commercial use or digital manipulation.

"Music has always been very personal to me," Nautiyal stated, explaining his decision to approach the court. "My name, my face, and my voice are not just parts of my profession; they are deeply connected to who I am and to a journey that the audience has supported with immense love over the years". He emphasized that the unauthorized use of these elements affects not only his work but also the emotional bond he shares with his listeners and family.

Suvigya Vidyarthi, part of Nautiyal's legal team, emphasized the legal basis for the petition, asserting that an artist's identity is a legally protectable asset. The legal team, also comprising Vivek Vidyarthi, Sarvagya Vidyarthi, Nischay Chaudhary, Apoorva Singh, and Rushali Rawat, is seeking judicial restraint against the misuse of Nautiyal's identity, alongside declaratory and injunctive relief. Vidyarthi stated that any exploitation of an artist's identity must be subject to their free, informed, and prior consent.

Nautiyal expressed hope that his actions would contribute to upholding respect for every artist who dedicates their heart to their craft. "This step is taken with humility and responsibility," he added. "It is not only for myself but also in the hope that it helps uphold respect for every artiste who gives their heart to their craft". He conveyed his trust that the court will ensure that personal identities are treated with care, integrity, and consideration.

In recent years, a growing number of Indian celebrities have turned to the courts to protect their personality rights, spurred by increasing concerns over the misuse of their identities in the digital sphere. This legal route has become increasingly necessary to combat the unauthorized commercial exploitation of a celebrity’s name, image, and likeness.

Jubin Nautiyal, born on June 14, 1989, has established himself as a prominent playback singer in the Indian music industry. He has recorded songs in various Indian languages, predominantly Hindi, and has received several awards, including the IIFA award for "Playback Singer (Male)" in 2022. He is signed on by T-Series.
