Former BRS MLA, Now German Citizen, Continues Receiving Pension Payments from Telangana Legislature.

A year after the Telangana High Court declared that former BRS MLA Chennamaneni Ramesh was not an Indian citizen and fined him ₹30 lakh for concealing his German citizenship while contesting assembly elections, he continues to receive a pension of ₹60,000 as a former MLA.

Congress MLA Adi Srinivas has urged the assembly secretary to stop Ramesh's pension, arguing that he is not entitled to any government benefits, and has demanded the recovery of benefits, emoluments, and salary already given to Ramesh. Srinivas, who had challenged Ramesh's citizenship, stated he would approach the High Court again if necessary, as there has been no action on his previous request.

Sources indicate that the assembly secretary previously informed Srinivas that the High Court order did not mention recovering salary and other emoluments from Ramesh, and there was no provision under existing rules to make such recoveries. Under the Telangana assembly rules, former MLAs are entitled to a pension, medical reimbursement, and other benefits. Because Ramesh served four terms as MLA from Vemulawada, he has been drawing over ₹50,000 as a monthly pension since December 2023.

The Telangana High Court declared Chennamaneni Ramesh a German citizen on December 9, 2024, and imposed a ₹30 lakh fine for concealing facts about his German citizenship from the court. Justice B. Vijaysen Reddy stated that Ramesh's actions of contesting elections since 2009 denied a genuine Indian citizen the right to contest and win. The court also upheld the Union Ministry of Home Affairs' order cancelling Ramesh's Indian citizenship. Of the ₹30 lakh penalty, ₹25 lakh is to be paid to Srinivas and the remaining ₹5 lakh to the state legal services authority.

Adi Srinivas, who lost to Ramesh in the 2009, 2010, 2014, and 2018 elections, won in 2023 from Vemulawada against BRS' Ch Lakshmi Narasimha Rao after Ramesh was denied a ticket by BRS leadership. The High Court observed that Ramesh could not furnish any document from the German Embassy proving he was not a citizen of Germany. The Ministry of Home Affairs stated that Ramesh had retained his German citizenship and passport all along.

Former Telangana Advocate General K. Rama Krishna Reddy stated that the legislative secretary cannot decide on pension issues, as he does not have adjudicating powers. The Assembly Speaker can decide whether Ramesh is entitled to the pension, as this decision needs to be taken after the court case. Srinivas can also approach the competent court on the issue.

Srinivas had approached the Supreme Court by filing a special leave petition to declare him elected for the terms Ramesh served as MLA, but in August 2024, the Supreme Court declined to interfere. The court observed that Ramesh misled officials, contested in the Assembly elections, and submitted false documents to the court, suppressing his German citizenship details. Ramesh became a German citizen in the 1990s through naturalization, having obtained a job, married a German woman, and had children in Germany.
