Shoe hurled at Indian Chief Justice amid religious tensions: An act of protest or disrespect?

In a stunning incident at the Supreme Court of India, an advocate allegedly hurled a shoe at Chief Justice of India (CJI) B.R. Gavai during court proceedings on Monday. The incident, which took place around 11:35 am in Court No. 1, prompted immediate action, with the lawyer being taken into custody.

The individual, identified as Rakesh Kishore, a 71-year-old advocate, reportedly shouted slogans related to Sanatan Dharma before attempting to throw the shoe. Witnesses stated that Kishore was heard yelling, "India won't tolerate Sanatan's insult". The shoe did not reach the bench where the Chief Justice was seated. Security personnel swiftly intervened and apprehended Kishore.

CJI Gavai remained composed throughout the disruption. He stated, "I am the last person to be affected by such things," and continued with the hearing.

The incident is believed to be connected to the criticism CJI Gavai faced after his remarks during a hearing regarding a plea seeking the restoration of a Lord Vishnu idol at the Khajuraho Temple complex in Madhya Pradesh. The court had dismissed the plea, terming it a "publicity interest litigation" and suggesting the petitioner ask the deity himself to do something. These comments sparked controversy on social media, with some accusing the CJI of disrespecting religious sentiments.

Following the social media backlash, CJI Gavai clarified that he respects all religions and that his comments had been misinterpreted.

The Bar Council of India (BCI) has taken immediate action, suspending advocate Rakesh Kishore from practicing law in any court, tribunal, or authority in India. The BCI cited the act as a violation of professional ethics and the dignity of the court. Disciplinary proceedings will be initiated against him, and he has been asked to explain within 15 days why the suspension should not be continued. The Delhi Police have released Rakesh Kishore as the Supreme Court Registrar declined to press charges. A white paper note was recovered from Kishore, stating, "My message is for all followers of Hinduism, this country will not tolerate any disrespect to Hinduism".

Political leaders across party lines have condemned the incident. Congress chief Mallikarjun Kharge called the act shameful and said it shows how hate and fanaticism have engulfed society. Rahul Gandhi and Sonia Gandhi also strongly condemned the incident, terming it an assault on the Constitution. Solicitor General Tushar Mehta described the act as "unfortunate and condemnable," attributing it to misinformation and a bid for cheap publicity. Senior advocate Indira Jaising called for a thorough investigation, suggesting it was a casteist attack on the Supreme Court.
