Nehal Modi, the brother of fugitive diamantaire Nirav Modi, has been apprehended in the United States following an extradition request from India. The arrest was made based on requests from the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED).
Nehal Modi, 46, was taken into custody on Friday, with U.S. authorities informing Indian officials of the development. His next court appearance is scheduled for July 17, where he is expected to seek bail. However, U.S. prosecutors are likely to oppose the bail plea.
The extradition request is based on two charges: one count of money laundering under Section 3 of the Prevention of Money Laundering Act (PMLA), 2002, and one count of criminal conspiracy under Sections 120-B (criminal conspiracy) and 201 (causing disappearance of evidence) of the Indian Penal Code.
The case is related to the ₹13,000 crore fraud at Punjab National Bank (PNB), allegedly orchestrated by Nirav Modi, Nehal Modi, and their uncle Mehul Choksi. Nehal Modi is accused of playing a key role in laundering the proceeds of crime on behalf of Nirav Modi. He allegedly helped conceal and transfer large sums of illicit funds through a network of shell companies and offshore transactions. The ED has accused him of destruction of evidence and of "knowingly and intentionally" assisting Nirav Modi in his alleged illegal activities.
Nehal Modi is a Belgian national, born and raised in Antwerp, and is fluent in English, Gujarati, and Hindi. He is wanted in India for allegedly laundering money in connection with the PNB scam. Nirav Modi is currently lodged in a London prison and is fighting extradition to India.
