IAS Officer Faces Criticism: Judiciary Remarks Spark Controversy and Prompt Scrutiny of Center Head

The head of an IAS training center is facing scrutiny and potential legal action following controversial remarks made about the judiciary. Vikas Divyakirti, the founder and managing director of Drishti IAS coaching institute, is at the center of the controversy. The issue stems from a YouTube video titled "IAS versus Judge, who is powerful," where Divyakirti allegedly made defamatory statements against the judiciary.

Advocate Kamlesh Manowliya filed a petition in the Judicial Magistrate Court No-2 in Ajmer, leading the court to take cognizance of the matter. Manowliya presented social media clips in which Divyakirti discussed "jugaad" (informal arrangements) in relation to judicial appointments and the collegium system. The court has charged Divyakirti under multiple subsections of Section 356 of the BNS Act 2023 and directed him to appear in person on July 22.

The complainant's legal team argued that Divyakirti's statements damage the judiciary's image. Specifically, the court was informed that Divyakirti allegedly claimed that files of potential judges could be delayed through government red tape, even after collegium approval. He also allegedly made controversial comparisons between the powers of district judges and district magistrates, implying that judicial power is dependent on police cooperation.

The controversy raises important questions about the relationship between the IAS and the judiciary, as well as the importance of maintaining the public's trust in both institutions. The judiciary's role as the guardian of the Indian Constitution and protector of rights necessitates that it be free from external pressures and that its integrity be beyond reproach. Public confidence is essential for the judiciary to effectively discharge its duties.

Conversely, it is also important that the judiciary remains open to constructive criticism and is held accountable for its actions. Some argue that the judiciary is not as accountable to the public as the legislature and executive branches. Concerns have also been raised about the transparency of judicial appointments and the use of certain constitutional provisions.

This incident occurs against the backdrop of ongoing debates about judicial reforms in India. Issues such as case pendency, delays in justice, lack of transparency in appointments, and inadequate infrastructure continue to plague the Indian judicial system. There are calls for reforms such as the creation of an independent judicial commission to ensure transparency and accountability in judicial appointments.

The controversy surrounding Divyakirti's remarks underscores the need for a balanced approach that respects the independence of the judiciary while also ensuring its accountability and transparency. It also highlights the importance of responsible public discourse, especially from individuals in positions of influence such as heads of IAS training centers. The case will likely continue to develop as Divyakirti prepares to appear in court and defend himself against the charges.
