Citizens' Welfare Paramount: Democracy's Branches Must Collaborate, Not Isolate, Declares CJI Gavai.

Chief Justice of India (CJI) Bhushan Ramkrishna Gavai has emphasized the importance of collaboration among the different branches of democracy for the welfare of citizens. Addressing a gathering on November 5, 2025, CJI Gavai stated that the executive, legislature, and judiciary all exist to serve the people and cannot function effectively in isolation.

CJI Gavai has been a vocal advocate for the Constitution and the responsibilities of each arm of the government. Earlier this year, he stated that the Constitution is supreme, and all three wings of democracy work under it. He referenced the basic structure doctrine, noting that while Parliament can amend the Constitution, it cannot alter its fundamental structure. He has also stressed the importance of a balanced relationship between the Union and the states for maintaining federal harmony.

In addition to his comments on the structure of Indian democracy, CJI Gavai has spoken on the importance of judicial independence. He defended the collegium system as a balanced mechanism involving inputs from both the Centre and states, ensuring judicial independence while upholding Constitutional propriety. He has also emphasized the need for judges to exercise power with humility and responsibility to uphold public faith. He noted that consistent and reasonable court judgments are vital for strengthening public confidence in the legal system.

Furthermore, CJI Gavai has highlighted the importance of human dignity as a core constitutional value. Speaking at the 11th Dr. L. M. Singhvi Memorial Lecture, he emphasized the judiciary's role in upholding constitutional values and dignity. He has also stated that the right to life includes access to food, clean air, water, and education.

CJI Gavai's tenure has also seen him address other important issues related to justice and the rule of law. In October 2025, he made a significant statement emphasizing that India is governed by law, not by "bulldozers". This statement referenced a Supreme Court judgment that laid down guidelines for the demolition of dwelling units, sending a clear message against using demolitions as a form of punishment.

In September 2025, CJI Gavai clarified remarks he made on the Khajuraho temple case, emphasizing that he respects all religions. This clarification came after social media misinterpreted his comments on the Vishnu idol matter.

Recently, on October 27, 2025, CJI Gavai recommended Justice Surya Kant, the senior-most judge of the Supreme Court, as his successor. Justice Kant is expected to assume office as the 53rd Chief Justice of India. The government had requested CJI Gavai's recommendation the previous week while he was on an official visit to Bhutan.

CJI Gavai's comments consistently reflect a commitment to upholding the Constitution, promoting collaboration among the branches of government, and ensuring justice and dignity for all citizens. His emphasis on the importance of each wing of democracy working together underscores the necessity of a cohesive approach to governance, with the ultimate goal of serving the welfare of the people.
