The family of Aniket Dabholkar, a 30-year-old junior engineer with Konkan Railways, has been awarded approximately ₹2.21 crore by the Motor Accident Claims Tribunal in Mumbai. The compensation, which includes interest, is to be paid by the Maharashtra State Road Transport Corporation (MSRTC) following Dabholkar's death in a 2023 accident.
On December 21, 2023, Dabholkar was fatally struck by a speeding state-owned MSRTC bus while standing near his parked scooter during a trip to the market with his father. His father was purchasing vegetables at the time. The bus veered off the road and hit Dabholkar, causing severe head injuries that led to his death. At the time of the accident, Dabholkar was a father to a one-year-old child.
The Motor Accident Claims Tribunal dismissed attempts by MSRTC to place blame on the deceased, emphasizing that evidence and police reports indicated the scooter was stationary and the bus driver lost control of the vehicle. The tribunal stated, "The fact that the driver of the offending bus drove the vehicle at a high speed and recklessly and caused the accident resulting in death of a person standing still by the side of the road indicates negligence". The order was passed on December 12.
The family pursued legal recourse and moved the tribunal on January 20, 2024. The tribunal concluded, "The claimants have duly proved negligence on the part of the accused driver". In determining the compensation amount, the tribunal considered Dabholkar's monthly salary of approximately ₹84,000 or ₹1 lakh and his career prospects. The principal compensation amount was set at ₹1.95 crore, covering loss of dependency, funeral expenses, and emotional suffering experienced by his 24-year-old widow, infant son, and elderly parents.
The MSRTC has been directed to deposit the funds within 30 days, which must include 7% annual interest. Of the total compensation, ₹95 lakh each has been allocated to the wife and son, with the remaining amount to be shared by Dabholkar's parents.
Other similar incidents have resulted in compensation being awarded. In a separate case, the Delhi Motor Accident Claims Tribunal awarded ₹1.26 crore to the family of Manish Kumar Chaudhary, who died in an accident involving a DTC bus, finding the bus driver negligent. Also, the Motor Accident Claims Tribunal (MACT) in Maharashtra's Thane district, awarded ₹27.9 lakh to the family of a bus driver who died in a 2011 collision, holding the truck driver solely responsible. Similarly, in another case, the MACT directed MSRTC to pay ₹13.95 lakh to the family of a labourer killed in a bus accident in 2021, attributing the accident to the negligence of the MSRTC bus driver.
