In a stunning turn of events, Hollywood star Will Smith is facing a lawsuit filed by Brian King Joseph, a violinist who toured with him, alleging sexual harassment and wrongful termination. The lawsuit, filed in the Superior Court of California, County of Los Angeles on December 30, 2025, details a series of disturbing events that allegedly occurred during Smith's "Based on a True Story: 2025" tour.
Joseph, who gained prominence after finishing third on "America's Got Talent" in 2018, claims that Smith engaged in "predatory behavior" and was "deliberately grooming and priming" him for sexual exploitation. The complaint centers around an incident in March 2025, during a tour stop in Las Vegas. Joseph alleges that he returned to his hotel room to find evidence of unauthorized entry. According to the lawsuit, there were no signs of forced entry, and hotel security informed him that only hotel staff and tour management personnel had access to the room.
Inside the room, Joseph reportedly discovered a handwritten note signed "Stone F" that read, "Brian, I'll be back...just us," accompanied by a heart drawing. In addition to the note, Joseph also found wipes, a beer bottle, a red backpack, HIV medication with another individual's name on it, an earring, and hospital discharge paperwork belonging to a person he did not know. Joseph says he felt terrorized by the implication that an unidentified individual would return to the room for a sexual encounter.
Joseph reported the incident to hotel staff, police, and tour management. However, he claims that tour management accused him of fabricating the story and subsequently terminated his employment. Joseph alleges he was told that the tour was "moving in a different direction," but that another violinist was hired to replace him.
The lawsuit alleges retaliation under California's Fair Employment and Housing Act and Labor Code, wrongful termination in violation of public policy, and violations of the Bane and Ralph Acts. Joseph is seeking compensatory and punitive damages, as well as injunctive relief. He claims the ordeal caused severe emotional distress, financial loss, and long-term psychological harm, including post-traumatic stress disorder (PTSD).
The lawsuit also suggests that Smith's prior interactions with Joseph were part of a pattern of predatory behavior. Joseph cited past comments from Smith, such as, "You and I have a special bond that no one else has".
As of now, representatives for Will Smith have not publicly responded to the allegations. The outcome of the lawsuit and whether the allegations will be substantiated in court remain unknown. This is a developing story, and further information will be provided as it becomes available.
