Aminul Islam, an All India United Democratic Front (AIUDF) MLA from Dhing, Assam, has been detained under the National Security Act (NSA) following his controversial remarks regarding the Pahalgam terror attack. The detention order, issued by the District Magistrate of Nagaon, follows a report from the Superintendent of Police (SP) concerning a provocative speech made by Islam during a Panchayat election campaign.
In the widely circulated video, Islam is accused of making inflammatory claims that linked the Pahalgam terror attack to a government conspiracy. Specifically, he allegedly implicated Prime Minister Narendra Modi and Union Home Minister Amit Shah, suggesting their involvement in the Pahalgam and Pulwama terror attacks. Islam reportedly stated that the BJP benefited politically from the 2019 Pulwama incident and insinuated a similar motive behind the recent attack in Pahalgam. He claimed the government had a role if it failed to uncover the truth about the attack on tourists.
The Assam Police arrested Islam on April 24 and booked him under multiple sections of the Indian Penal Code. These sections include 152, 196, 197(i), 113(i), 352, and 353. After being granted bail on Wednesday, Islam was immediately detained under the NSA. He is currently lodged in Nagaon Central Jail.
Chief Minister Himanta Biswa Sarma confirmed the detention, stating that it was based on the SP's report highlighting Islam's speech and the viral video. Sarma has emphasized that the state will take strict legal action against any attempt to incite communal tension or undermine national security. He also disclosed that 61 individuals, including Islam, have been arrested across Assam for alleged pro-Pakistan sentiments following the Pahalgam attack.
The AIUDF has distanced itself from Islam's statements, with party chief Badruddin Ajmal clarifying that the comments reflected Islam's personal views and not the party's official position. Ajmal stated that it was unfortunate Islam made those remarks.
The National Security Act of 1980 allows the central or state government to detain individuals without formal charges or a trial for up to 12 months in preventive detention. According to a senior police officer, the NSA dossier against Islam includes reference to 23 previous cases registered against him.
Islam was previously arrested in April 2020 for allegedly making derogatory remarks about quarantine centers during the COVID-19 pandemic, calling them worse than detention centers.
The detention order from Nagaon District Magistrate Narendra Kumar Shah states that Islam has been engaging in activities prejudicial to the maintenance of public order and the security of the state. The order further adds that the Magistrate is satisfied that Islam is likely to continue engaging in such activities.
