The Delhi High Court has sought a response from the Election Commission of India (ECI) regarding a plea filed by the Akhil Bharatiya Jan Sangh (ABJS) seeking the allotment of a poll symbol for the approaching Bihar Assembly elections.
Justice Mini Pushkarna, presiding over the case, issued a notice to the ECI, instructing them to submit their response by October 9, 2025, the date set for the next hearing on the matter. This legal proceeding follows an earlier plea by ABJS in August, where the court also sought the ECI's response regarding the party's request to use a common election symbol in the Bihar Assembly polls.
The ECI had previously rejected ABJS's request for a common election symbol, citing internal disputes within the party. However, the counsel representing the petitioner argued that the dispute was no longer relevant as Sameer Singh Chandel, who was central to the alleged rift, had been expelled from the party and no longer has any involvement in the party's affairs. The court, acknowledging the petitioner's submissions, then sought the ECI's stance on this fresh plea.
The ABJS, established in 1951 and renamed in 1979, has been a consistent participant in elections across the country. The party highlighted its participation in the 2024 Andhra Pradesh Assembly elections, where the ECI allotted it the "sitar" as a common election symbol. The petitioner contends that denying them a poll symbol infringes upon their constitutional and statutory rights to contest elections, effectively hindering their participation in the democratic process.
Advocates Pranay Ranjan and Mrigank Prabhakar are representing the Akhil Bharatiya Jan Sangh, while Advocate Rohini Prasad is representing the ECI. The court may decide the matter on October 9, after hearing from both parties. The hearing could determine whether the Akhil Bharatiya Jan Sangh will be permitted to contest the Bihar assembly elections with its requested common party symbol.
