Delhi Court Orders Wife to Restore Husband's Property Possession After Illegal Ousting: A Landmark Decision.

A Delhi court has ordered a woman to return possession of a property to her husband, from whom she had ousted him, after she failed to provide sufficient documentation proving her ownership rights. District Judge Ankur Jain presided over the case, which was brought forth by the husband who claimed his wife had evicted him due to marital discord. Advocate Manish Bhadauria represented the husband in the matter.

The court's decision was based on the woman's inability to substantiate her claim of ownership over the property. The specific details of the marital dispute that led to the ousting were not disclosed; however, the court focused on the central issue of property rights.

In a similar case, another Delhi court directed the recovery of a house from an estranged wife, citing a violation of a mutual divorce settlement. In this instance, Family Court Judge Savitri heard a plea from the husband, who stated that his former wife had breached the settlement terms. The agreement stipulated that she would receive ₹11 lakh as a full and final settlement. Advocate Manish Bhadauria also represented the husband in this case.

The court noted that despite receiving the full settlement amount, the woman had trespassed and occupied the first floor of the property. In an order dated September 16, 2025, the court stated that the woman's claim of residing on the first floor prior to the agreement was not supported by the divorce settlement. The court also dismissed her plea of being a helpless divorcee with the responsibility of two minor children.

The court further stated that upon accepting the settlement, the woman relinquished any claim to the property and could not dishonestly violate the agreement. The husband had remarried and required the space for his own use. The court found that the woman was offered an opportunity to vacate the property but remained adamant, leading to the order for coercive action and directed the police to assist the husband in recovering possession of the property. The matter was scheduled for a possession report on October 8, 2025.
