The Supreme Court (SC) of India has intervened in the ongoing divorce case between cricketer Mohammad Shami and his estranged wife, Hasin Jahan. On Friday, the SC issued notices to Shami and the West Bengal government, seeking their responses to Jahan's plea for an increase in the alimony previously granted to her and their daughter by the Calcutta High Court.
The Calcutta High Court had earlier directed Shami to pay a monthly alimony of ₹4 lakh, allocating ₹1.5 lakh for Jahan and ₹2.5 lakh for their daughter's maintenance. Jahan is now contesting this amount, arguing that it is insufficient considering Shami's substantial income and lifestyle.
During the SC hearing, the bench acknowledged that the interim maintenance amount granted by the High Court was "quite handsome". However, the court proceeded to seek responses from Shami and the West Bengal government within four weeks. The case is scheduled to be heard again in December.
Jahan's counsel, Imtiaz Ahmed, argued that Shami's total income is ₹7,19,54,010, challenging the lower court's initial decision to grant only ₹50,000 and ₹80,000 as interim relief. He stated that Jahan earns ₹16,000 a month while her monthly expenses are around ₹6,12,905. Conversely, Shami's counsel, Sandipan Ganguly, claimed that Jahan had misrepresented herself as destitute.
Jahan's petition alleges that Shami has defaulted on payments for several months, despite directives from both the family court and the Calcutta High Court. She maintains that while she doesn't claim a personal right over her husband's income, their daughter is entitled to a standard of living similar to that of her father, including access to good schools and a life of dignity.
The legal battle between Shami and Jahan began in 2018 when Jahan filed an FIR against Shami and his family, accusing them of domestic violence, dowry harassment, and match-fixing. She initially sought ₹7 lakh per month for herself and ₹3 lakh for their daughter as interim maintenance. Shami has described his marriage as the "biggest mistake" of his life and admitted that the experience had a deep impact on him.
Hasin Jahan and Mohammed Shami's relationship began in 2012 during the IPL season, where she was a cheerleader for KKR and he was a player. They married on June 6, 2014, and have a daughter born in 2015.
