Delhi High Court Upholds Ban: Ravi Mohan's Film "Bro Code" Title Remains Restricted Due to Copyright Dispute.

The Delhi High Court has refused to lift an interim injunction that prevents Ravi Mohan Studios Private Limited, actor Ravi Mohan's production company, from using the title "BRO CODE" for its upcoming film. The decision came amidst a trademark infringement suit filed by Indospirit Beverages Private Limited, the company that produces the carbonated wine-in-a-pint beverage also known as BRO CODE.

A single-judge order, initially issued on October 14, barred the film studio from using the title, determining that using an identical mark for a film title could confuse consumers and dilute the goodwill associated with Indospirit's beverage brand.

On Wednesday, a Division Bench of Justices Hari Shankar and Om Prakash Shukla upheld the single-judge's order. The bench observed that granting a stay at this stage would essentially allow the appeal. While issuing a notice regarding the studio's appeal against the injunction, the court declined to suspend the original order and scheduled the final hearing for December 5.

During Wednesday's proceedings, the Division Bench questioned Indospirit about the statutory basis for the injunction, seeking clarification on which subsection of Section 29 of the Trade Marks Act, 1999, applied in this case. The Bench noted that the single-judge order had not specifically invoked Section 29(4) or recorded findings on its key conditions, remarking that the order lacked a prima facie discussion of the relevant statutory provisions.

Indospirit Beverages, founded in 2014, claims to have been using the "BROCODE" mark since 2015 for its beverage line. More recently, they have expanded into digital content, launching the "BroCode Roast" on YouTube in 2025 and the "BroCode: Onam Ulsavam Song", which have collectively garnered millions of views online. Indospirit argued that using the same name as a film title constitutes trademark infringement and would damage the brand's reputation.

Ravi Mohan Studios, on the other hand, contends that it registered the copyright for the "BroCode" title for its script and artistic work in the entertainment category. They also stated that the beverage company had asked Ravi Mohan to promote their brand in the film, which he refused. The studio claims that Indospirit filed the case in Delhi as a publicity stunt to promote their brand in Tamil Nadu, where they are planning to launch it.

Notably, Ravi Mohan Studios has secured a victory in the Madras High Court regarding the title "Bro Code". The Madras High Court continues to uphold Ravi Mohan Studios' rights over the title, restraining Delhi Indo Beverages.

In response to the Delhi High Court's initial injunction, Ravi Mohan Studios stated, "RaviMohan studios registered its copyright 'BroCode' title for its script and its artistic work in entertainment category… So the beverage company has registered a case at Delhi against this Title and not challenged the Madras High Court verdict so far".

In addition to the appeal, Indospirit has filed a contempt petition against Ravi Mohan for alleged non-compliance with the October order. The Delhi High Court has issued a notice in that matter, which is currently pending adjudication. The single-judge order clarified that film production could continue as long as the injunction was observed. The court had ordered the studio to either drop or change the title while promoting or releasing the movie until the case is decided.
