The Calcutta High Court has granted conditional permission for a rally to be held on October 5, 2025, the same day as the Red Road Durga Puja Carnival. The decision comes after an organization close to the BJP sought permission to conduct a protest rally led by Suvendu Adhikari, the leader of the opposition in the West Bengal assembly.
The rally is intended to address the issue of electrocution deaths that occurred after heavy rainfall in Kolkata. The organizers had initially applied for permission to hold the rally, but Kolkata Police denied the request, citing concerns about the mega Durga Puja carnival at Red Road, which is expected to host 113 award-winning community Durga Puja committees and be attended by Chief Minister Mamata Banerjee.
Following the police denial, the organization approached the Calcutta High Court, and the case was heard by a vacation bench of Justice Biswaroop Chowdhury. The court acknowledged the unfortunate nature of the electrocution deaths and granted conditional approval for the rally to proceed.
To prevent clashes with the Durga Puja Carnival, the court has set specific restrictions on the rally. The rally is permitted to take place between 2 p.m. and 5 p.m. and the number of participants is capped at 3,000. The rally, organized by BJP-backed group Khola Hawa, is approved to march from College Square to Dorina Crossing.
The state's counsel questioned the timing of the rally on the carnival day, suggesting a political motive and warning of potential disturbances. However, the organizers' counsel maintained that the march aimed to highlight the electrocution deaths that occurred on September 23.
In a similar case in 2024, the Calcutta High Court allowed representatives of the medical fraternity to conduct a "Droh Carnival" to protest the rape and murder of a junior doctor of R G Kar Medical College & Hospital. The court dismissed prohibitory orders imposed by the city police for the protest and emphasized the fundamental right to peaceful protest.
