Chief Justice of India (CJI) Surya Kant has announced a new initiative aimed at ensuring equitable distribution of judicial time, prioritizing the cases of poor litigants. Effective January 2026, a time limit will be enforced for each advocate to conclude their arguments.
CJI Kant expressed his concern over the current situation where lengthy arguments by some advocates often lead to poor litigants being denied a fair chance to have their cases heard. He highlighted instances where individuals seeking justice in motor accident claims or bail matters are left disappointed as their cases are not addressed due to time constraints. The CJI emphasized that the judiciary is expected to bring a smile to every litigant's face.
The CJI made these remarks while presiding over a batch of Public Interest Litigations (PILs) challenging the Summary Revision of Electoral Rolls (SIR) in Bihar and across India. He observed that some cases continue for days because of drawn-out arguments by prominent senior advocates, which results in poor litigants having to return home without their cases being heard.
This initiative seeks to address the perception that the "rich, powerful, and influential" gain an unfair advantage by hiring high-profile lawyers, potentially disadvantaging others in the legal system. It may also impact legal professionals known for lengthy arguments and those who frequently file PILs on various issues.
CJI Kant acknowledged that according "privileged" treatment to celebrities creates an imbalance in the justice delivery system. He stated that equitable distribution of time is essential. Beginning in January, all counsel will be required to submit written submissions.
CJI Surya Kant, who assumed office on November 24, 2025, has emphasized that ensuring justice for poor litigants is a top priority. He has stated his willingness to work late into the night to ensure they receive justice. He dismissed a plea by Tilak Singh Dangi, stating, "No luxury litigation in my court...I am here for the smallest... poorest litigant in the last row. If needed, I will sit here till midnight for them".
